1.1 Eligibility: Participation in the Program is open only to individuals who are at least 18 years of age and who have purchased a qualifying product from a manufacturer participating in the Program. By participating, you represent and warrant that you meet all eligibility requirements.
1.2 No Duplicate Redemptions: You may not redeem multiple rebates for a single qualifying purchase. Any attempt to submit duplicate or fraudulent rebate requests will result in immediate denial of your rebate payout, at our sole discretion.
1.3 Compliance with Program Rules: Participation in the Program constitutes your agreement to comply with all guidelines, policies, and instructions published by us in connection with the Program. We reserve the right to modify these rules at any time without notice.
2.1 Qualifying Purchases: To be eligible for a rebate, you must have purchased a qualifying product within the designated time period specified by the manufacturer and communicated by us. Proof of purchase (such as a receipt or order confirmation) must be submitted through our secure portal.
2.2 Time Window: Rebate submissions must be received within the time frame specified for each qualifying product. Rebates submitted outside of the designated time window will be automatically disqualified.
2.3 Payment Methods: Rebate payouts will be processed via PayPal or Stripe. You agree to provide accurate and current payment information. We are not responsible for any delays or errors resulting from inaccurate or incomplete payment information provided by you.
2.4 Denial of Payouts: In our sole discretion, we reserve the right to deny a rebate payout for any of the following reasons (including, but not limited to):
3.1 Manufacturer Programs: The Program is administered on behalf of participating manufacturers. All offers, promotions, and rebate amounts are determined solely by the manufacturers and are subject to their specific terms, which may be amended from time to time.
3.2 No Endorsement: Participation in the Program does not constitute an endorsement of any manufacturer, nor does it create any contractual relationship between you and the manufacturer. Your rebate claim is between you, the Company (as administrator), and the respective manufacturer.
4.1 No Warranty: The Program, including all information, content, and services provided, is offered “as is” and “as available” without any warranty of any kind, either express or implied. We do not warrant that the Program will be error-free, uninterrupted, or free from defects.
4.2 Limitation of Liability: In no event shall Midwest Label Supply LLC, its affiliates, officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the Program, even if advised of the possibility of such damages. Our total liability, if any, shall be limited to the amount of the rebate claimed.
4.3 Right to Correct Errors: In the event of any error, omission, or inaccuracy in connection with the Program, including mistakes in the calculation or processing of rebate amounts, we reserve the right, at our sole discretion, to correct such errors and to withhold any rebate payments until the error is resolved. Your acceptance of these Terms constitutes your agreement that no claim for damages shall be based on any such errors.
5.1 Modifications: We reserve the right to modify, suspend, or terminate the Program or any portion thereof at any time without prior notice. Changes to these Terms will be effective immediately upon posting on our website. Your continued participation in the Program after any such changes constitutes your acceptance of the revised Terms.
5.2 Termination: We may, in our sole discretion, terminate your participation in the Program for any reason, including without limitation, breach of these Terms, fraudulent behavior, or any other conduct that we determine to be detrimental to the Program or our interests.
You agree to indemnify, defend, and hold harmless Midwest Label Supply LLC, its subsidiaries, affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your participation in the Program or your breach of these Terms.
7.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles.
